TERMS AND CONDITIONS
All arrangements made between us, The AGENT, and you, The CLIENT, are subject to the following conditions at all times:
1. Confirmation of Booking
As agents we are authorized by the owners, or their representatives, to offer their property(s) for rental, and can indicate if a property is available between certain dates. However we can only confirm a booking upon receipt of the relevant deposit and completed booking form. A contract will exist only from the time we issue our confirmation of your booking. Any payment(s) received (by: cheque or credit & debit card) are subject to these conditions, and cancellation for any reason will also be subject to these conditions at all times. Any accommodation booking is only for the use of the clients named or numbered on the booking form, and any subletting, sharing, over occupation or assignment is prohibited. If for any reason we have to cancel your booking, we shall make every effort to offer you a suitable alternative, if you reject this we will at your request, and in full and final settlement, refund all amounts paid to date.
2. Initial Payment
At the time of your booking you will be asked to pay an initial deposit of 25% of the total cost of the property. This payment is your only commitment until 8 weeks prior to your departure.
3. Payment Balance
Any outstanding balance is due for payment 8 weeks before the date of departure. A reminder will be sent prior to the due date, but we cannot guarantee receipt. It is the responsibility of the person named on the booking form to ensure the final payment is made by the due date. If payment were not received on time, we would endeavour to contact the named person to request the payment. However if payment was still not forthcoming within 7 days of the due by date, or it was indicated that payment would not be forthcoming, we would have no alternative, and shall be entitled to cancel the booking and retain the deposit without notice.
4. Late Bookings
For bookings within 8 weeks of departure, you are required to convey the full payment and booking form immediately.
5. If You Cancel Your Booking
If you wish to cancel your booking, the person named on the booking form must do so by sending an email confirmation. Receipt of a cancellation request will only be valid once we have confirmed its receipt. In the event of a cancellation and to compensate for the expense of processing your booking and for any loss that may result from being unable to re-sell the holiday, we charge the following cancellation fees:

6. Insurance Requirements
Holiday and travel Insurance, including cancellation cover, is essential for your own protection and we strongly recommend that you and all members of your party be suitably insured.
7. Party Size
At no time must any more persons occupy a property than stated on the booking form, except with prior written agreement. Property owners or their agents reserve the right to refuse admittance if this condition is not observed.
8. Problems With Your Property
If you have a problem during your holiday, immediately inform us and we will endeavour to put things right. If you fail to do this we cannot accept responsibility, as we have not had the opportunity to investigate and rectify the problem.
9. Services
We are unable to accept responsibility for any inconvenience caused by disturbance of any kind, and at any time from neighbouring property, land, tenants/clients or animals. Or by the failure of local services for any length of time, such as electricity, water supply, electric or gas equipment. Or for the unavailability of any general amenities, including television (analogue or satellite), swimming pools that may have to drained and re-filled from time to time, road works or condition of roads. As we have no jurisdiction, we therefore cannot guarantee availability in regard to community pools. It should be noted
that most swimming pools are not available during the winter months, the usual available period for most complexes is May – October, but this is completely at the discretion of the complex President. The use of all electrical items such as- washing machine, dishwasher, iron, radio/cassette, kettle, coffee maker etc. is entirely at the discretion of the user, and we will not be responsible for any injury or damage that may be a result of such usage. The owners of each property, or local agents provide the linen & towels, as we have no control over the amount or quality of such items, we can therefore not be responsible for such. A guarantee cannot be given to the availability, or condition of BBQ’s. Views from the property may change from time to time due to happenings/building beyond our control, and cannot therefore always be guaranteed. Any damages/breakage’s must be replaced or paid for. We retain the right to charge for damages/breakage’s upon your return, if not replaced or paid for at the time of occupancy.
10. Occupancy
Your accommodation is available from 3pm on day of arrival and must be vacated by 10am on day of departure. The cleaners need this time to prepare the accommodation properly for incoming guests. However if circumstances permit these times may be varied, but this must be pre-arranged.
11. Breakages & Damages
We may request a security deposit but if not, we do trust you to report any breakages or damages to us. You will be required to pay for any repairs or replacements as necessary by way of the credit card authority.
12. Property Standards
We have carefully selected and inspected all the properties that we advertise and we endeavour to maintain high standards. However, inevitably, items break or require maintenance, therefore please be aware that you may encounter maintenance staff and gardeners during your stay. Please note that tiled surfaces can become very slippery when wet, take extra care if your feet are wet after using the pool. Please also remember that these are people's homes - please leave the property in a reasonably clean and tidy condition. We reserve the right to charge for extra cleaning if necessary.
13. On Arrival
Immediately upon arrival at your holiday home please familiarise yourself with the layout of the property and identify any potential hazards e.g. unexpected steps, slippery surfaces etc.
14. Safes
In those properties that provide a safe for guest use we cannot accept responsibility for any loss under any circumstances.
15. Included in the Cost
- All linen changed weekly
- Towels but not pool towels (unless otherwise stated)
- Pool and garden maintenance
- All water and electricity
- All local and other taxes
16. Links to Third Party Sites
123 Spanish Solutions cannot and has not reviewed all pages of the sites linked to this Site and therefore cannot be liable for their content. Users link to other sites at their own risk and use such sites according to the terms and conditions of use of such sites. 17. Copyright
No part of this website may be copied or imitated in whole or in part. No logo, graphic, sound or image from this website may be copied or re-transmitted unless expressly permitted in writing by 123 Spanish Solutions Ltd.
18. Governing Law
Any dispute or claim concerning or arising from this website shall be determined in accordance with the law of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction in determining such disputes or claims.
19. Passports, Visas and travel advice
It is your responsibility to ensure that you comply with regulations governing entry to Spain. If you are unable to travel as a result of documentation not being in order you will not be able to claim any refunds from us and cancellation charges would apply as set out. This includes not being able to travel due to a mislaid or lost passport. The Foreign and Commonwealth Travel Advice Office issues travel advice, which is regularly updated. 20. General
The information given is to the best of our knowledge correct at time of press. Information is subject to change without notice.
